2. 3. The passenger may bring an action for damages caused in case of death or injury of passengers and delay, damage or loss of luggage. The legal action must be filed within 2 years since the date the aircraft has arrived or should have arrived, according to Montreal Convention. The same term is incident for the damages caused as a result of the refusal to embark, the delay or cancellation of the flight in cases where the provisions of Regulation (EC) no. 261/2004 establishing common rules regarding compensation and assistance for passengers in the event of refusal to board and cancellation or delayed flights and repealing Regulation (EEC) no. 295/91 are applied.
The passenger who has not filed a complaint regarding damaged / delayed / lost luggage, in accordance with the provisions of the transport contract, in accordance with the Montreal Convention or, as the case may be, the Regulation (EC) no. 889/2002 of the European Parliament and of the Council of 13 May 2002 amending the Council Regulation (EC) no. 2027/97 regarding the liability of air carriers in the event of accidents, will not be able to take legal action against the carrier.
4. The passenger may initiate an action for damages caused by the refusal to embark, delay or cancellation of the flight, according to Regulation (EC) no. 261/2004 establishing common rules regarding compensation and assistance for passengers in the event of refusal to board and cancellation or delayed flights and repealing Regulation (EEC) no. 295/91, within the term provided by the rules of each Member State regarding the issue of extinguishing prescription.
